Welcome to Fishprep’s site. We hope you like it, enjoy it and find it useful. We are open and transparent with how we treat users and their information, and we ask that you respect fellow users of Fishprep and treat them as you would your fellow fishermen on the bankside.

We have always cared deeply about data protection and privacy and we welcome the General Data Protection Regulation, which comes into force May 25 2018.

WEBSITE TERMS AND CONDITIONS OF USE

  1. TERMS OF WEBSITE USE
    1. These terms of use (together with the documents referred to in it) tells you the terms of use on which you may make use of our site https://www.fishprep.com/ (“Our Site”), whether as a guest or a registered user (“Terms of Use”). Use of Our Site includes accessing, browsing, and registering to use Our Site.
    2. Please read these Terms of Use carefully before you start to use Our Site, as these will apply to your use of Our Site, and by using Our Site, you confirm that you accept these Terms of Use and that you agree to comply with them.
    3. If you do not agree to these terms of use, you must not use Our Site.
    4. We have additional Terms of Use that apply to our Business Users, and these are available here.

    1. https://www.fishprep.com/ is a site operated by Prep Group AB ("We"). We are registered in Sweden under company number 556958-2777 and have our registered office and main trading address is at Österby 66, 78395, Gustafs, Sweden. Our VAT number is SE556958277701.

    2. Please check this page from time to time to take notice of any changes we made, as they are binding on you.
  6. ACCESSING AND USING OUR SITE
    1. We do not guarantee that Our Site or any content on it will always be available or be uninterrupted, free from errors or omissions, and We will not be liable to you if for any reason Our Site is unavailable at any time or for any period.
    2. Access to Our Site is permitted on a temporary basis.
    3. We may update Our Site from time to time, and may change the content at any time. However, please note that any of the content on Our Site may be out of date at any given time, and we are under no obligation to update it.
    4. At our discretion We may suspend, withdraw, discontinue or change all or any part of Our Site without notice, and if We do so, you must not circumvent or bypass (or attempt to do so) any access restriction measures on Our Site.
    5. You are responsible for making all arrangements necessary for you to have access to Our Site.
    6. You are also responsible for ensuring that all persons who access Our Site through your internet connection are aware of these Terms of Use and other applicable terms and conditions, and that they comply with them.
    7. You agree that your use of Our Site will be in accordance with our Acceptable Use Policy which is available here.
  7. REGISTRATION, YOUR ACCOUNT AND PASSWORD
    1. You may register and for an account with us and subscribe to Our Site by completing and submitting the account registration form available here.
    2. As part of your subscription you are provided with a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential and not disclose it to any third party.
    3. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.
    4. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at info@fishprep.com.
    5. You are responsible for any activity on Our Site arising out of any failure to keep your password confidential, and may be held liable for any losses arising out of any failure to keep your password confidential.
  8. BUSINESS USERS
    1. If you are a Business User you must pay a non-refundable annual subscription fee (amount available on request) for access to a business account. The subscription will renew automatically at the end of each year unless you decide to cancel your account.
    2. Business Users may cancel a business account with us at any time but will not receive a refund of the annual subscription fee. It is a small fee and, although it is non-refundable, were you to cancel your account but decide to re-open it again later in the same year, We would not charge you again for the rest of that year (but a new subscription fee would apply as described in 8.1 in the following year).
    3. As part of the annual subscription Business Users will receive: (1) a placement on our map; and (2) a profile page from which to advertise your business.
    4. If you are a Business User you agree that (save as set out in this Section 8) you will be bound by the other terms and conditions of the Terms of Use.
  9. CANCELLATION AND SUSPENSION OF ACCOUNT
    1. We may suspend or cancel your account, or edit your account details at any time without notice or explanation.
    2. You may cancel your account with us at any time, unless you are a Business User, in which case, the provisions of Section 8 will apply.
  10. INTELLECTUAL PROPERTY RIGHTS
    1. We are the owner or the licensee of all trademarks, design rights, patents and other intellectual property rights (registered or unregistered) in Our Site, and in the material published on it. Those works are protected by copyright and other applicable laws and treaties around the world. All such rights are reserved.
    2. You may print off one copy, and may download extracts, of any page(s) from Our Site for your personal use and you may draw the attention of others within your organisation to content posted on Our Site, however you must not download any material from Our Site or save any such material to your computer for any other purpose.
    3. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
    4. Our status (and that of any identified contributors) as the authors of content on Our Site must always be acknowledged.
    5. You must not use any part of the content on Our Site for commercial purposes without obtaining a licence or permission to do so from us or Our licensors.
    6. If you print off, copy or download any part of Our Site in breach of these Terms of Use, your right to use Our Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

    8. Nothing in these Terms of Use grants you a right or licence to use any trade mark or design right in a name, logo or trade mark owned or controlled by us or any third party.
  11. NO RELIANCE ON INFORMATION
    1. The content on Our Site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on Our Site.
    2. Although we make reasonable efforts to update the information on Our Site, we make no representations, warranties or guarantees, whether express or implied that the content on Our Site is accurate, complete or up-to-date.
    3. We reserve the right to modify, suspend or discontinue any part of or all of Our Site services, and to stop publishing Our Site, at any time without any advance notice. Save to the extent expressly provided otherwise in these Terms of Use, you will not be entitled to any compensation or other payment upon the modification, suspension or discontinuance of any of Our Site services, or if we stop publishing Our Site.
  12. LIMITATION OF OUR LIABILITY
    1. Nothing in these Terms of Use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
    2. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to Our Site or any content on it, whether express or implied.
    3. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
    4. use of, or inability to use, Our Site; or
    5. use of or reliance on any content displayed on Our Site.
    6. If you are a Business User, please note that in particular, we will not be liable for:
    7. loss of profits, sales, business, or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation; or
    8. any indirect or consequential loss or damage.
    9. If you are a consumer user, please note that we only provide Our Site for domestic and private use. As a consumer, you may have certain legal rights regarding claims in respect of losses caused by our negligence or failure to carry out our obligations. Nothing in these Terms of Use is intended to limit your legal rights as a consumer. For further information about your legal rights you can contact your local authority.
    10. As a consumer, you agree not to use Our Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
    11. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of Our Site or to your downloading of any content on it, or on any website linked to it.
    12. We assume no responsibility for the content of websites linked on Our Site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
  13. UPLOADING CONTENT TO OUR SITE
    1. Whenever you make use of a feature that allows you to upload content to Our Site, or to make contact with other users of Our Site, you must comply with the content standards set out in Section 4 of our Acceptable Use Policy, available here.
    2. You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
    3. Any content you upload to Our Site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but by making available any content on Our Site you thereby grant Us and other users of Our Site a limited licence to use, store and copy that content and to distribute and make it available to third parties. The rights you licence to Us are described in Section 14 (Rights You Licence to Us).
    4. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to Our Site constitutes a violation of their intellectual property rights, or of their right to privacy.
    5. We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of Our Site.
    6. We have the right to remove any posting you make on Our Site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy, available here.
    7. The views expressed by other users on Our Site do not represent our views or values.
  14. RIGHTS YOU LICENCE TO US
    1. When you upload or post content to Our Site, you:-
    2. grant us a worldwide irrevocable non-exclusive royalty free licence to use, reproduce, store, adapt, publish, translate, and distribute your content (or excerpts thereof) in any existing or future media and to reproduce, store and publish your content on and in relation to Our Site and any successor website.
    3. grant us the right to sub-license the rights licensed under these Terms of Use.
    4. grant to us the right to bring an action for infringement of the rights licensed under Section 14.1.1.
    5. hereby waive all your moral rights in your content to the maximum extent permitted by applicable law; and you warrant and represent that all other moral rights in your content have been waived to the maximum extent permitted by applicable law.
    6. must comply in all respects with the content standards set out in Section 4 of our Acceptable Use Policy, available here.
    7. Without prejudice to our other rights under these Terms of Use, if you breach any provision of these Terms of Use in any way, or if we reasonably suspect that you have breached these Terms of Use in any way, we may delete, unpublish or edit, or request that you delete, unpublish or edit any or all of your content.
    8. If we request that you remove content in accordance with Section 14.2 above you shall take appropriate remedial action with respect to any such request within 72 hours of receipt of such request.
  15. VIRUSES
    1. We do not guarantee that Our Site will be secure or free from bugs or viruses.
    2. You are responsible for configuring your information technology, computer programmes and platform in order to access Our Site. You should use your own virus protection software.
    3. You must not misuse Our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to Our Site, the server on which Our Site is stored or any server, computer or database connected to Our Site. You must not attack Our Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you could be committing a criminal offence. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use Our Site will cease immediately.
  16. BREACHES OF THESE TERMS OF USE
    1. We shall have the right to stop making all or part of Our Site available to you with immediate effect and without notice if:
    2. in our sole reasonable opinion you are using Our Site inappropriately (for instance harassing or causing distress or inconvenience to any other person), incompetently or in any way that may constitute derogatory treatment of Our Site or might bring us into disrepute or in a way that might be considered to be prejudicial to our image;
    3. you breach these Terms of Use in a way that cannot be corrected, or you fail to correct a breach within a reasonable period of time if we ask you to do so; or
    4. there is, in our sole reasonable opinion, a reason why your access to Our Site must be withdrawn.
  17. LINKING TO OUR SITE
    1. You may link to our site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. Its your responsibility to ascertain if you are permitted to link our site on a site not owned by you.
    2. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
    3. Our site must not be framed on any other site.
    4. We reserve the right to withdraw linking permission without notice.

    1. You may not assign, sub-licence or otherwise transfer any of the rights granted to you in these terms and conditions to any other person.
  20. SEVERABILITY
    1. If any part of these terms and conditions are found to be ineffective by a court or regulator, the other parts of these terms and conditions will continue to apply.
  21. APPLICABLE LAW
    1. These Terms of Use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction.
    2. The United Nations Convention for the International Sale of Goods shall not apply.
